1. Introduction
1.1. Please print and save these terms and conditions along with any correspondence we send to you for future reference.
1.2. These terms and conditions apply to all orders placed with us
1.3. Certain terms are repeated and for clarity are defined in section 11
1.4. We reserve the right to change these terms and conditions at any time prior to you placing an order. The changes take effect at the point they are posted on the website and you should refer to the terms and conditions every time you use the website.
2. Specifications
2.1. All sizes and measurements stated by us in relation to products are approximate.
2.2. It is your responsibility to provide accurate measurements for items that you require. We cannot be held responsible for inaccurate measurements supplied by the customer.
2.3. As computer monitors reproduce colours differently we cannot guarantee that the colour of items ordered will exactly match the colour as represented on your computer monitor.
2.4. Due to differing dye lots we cannot guarantee that the product supplied will be an exact match to any sample supplied, but will be within an acceptable commercial tolerance.
3. Payment and Pricing
3.1. All prices payable for our products are displayed on our website and are subject to change at any time.
3.2. All prices are shown in GBP and include VAT at the applicable rate.
3.3. If we discover an error in pricing after ordering we will inform you as soon as possible with the option to confirm the order at the correct price or cancel for a full refund. If we are unable to contact you we will cancel the order.
3.4. Provided that we have received and processed payment for goods, the title to any goods will pass to you on delivery.
4. Ordering
4.1. The website guides you through the process to create a contract of sale and you place the order by clicking order confirmation.
4.2. As all our products are made to your specification payment will be taken at the point you place your order using credit or debit card details supplied by you during the process. Please note that payment does not signify acceptance of your order or evidence of any contract.
4.3. Your order is subject to our acceptance
4.4. Acceptance of order will take place at the point we have sent a confirmation email accepting the goods, which will detail the goods along with the price and reference to these terms and conditions.
4.5. For orders paid for by cheque or postal order we will send the confirmation mail at the point the payment has cleared.
4.6. For orders that are not delivered to the UK mainland, all delivery charges will be agreed and processed before any order is accepted.
5. Delivery
5.1. Standard deliveries can only be made to addresses on the UK mainland.
5.2. Subject to item 4.6, deliveries can be made to Isle of Wight, Isle of Man, Channel Islands, Orkney, Shetland and Scottish Islands, Republic of Ireland.
5.3. For the avoidance of doubt Northern Ireland is considered part of mainland UK.
5.4. All goods must be signed for on receipt by an adult over 18 years of age.
5.5. Timescales stated on the website are estimates only and we shall have no liability for any delay or failure to deliver within the stated time due to circumstances beyond our control including, without limitation – strikes, lock-outs, other industrial disputes, flood, fire, explosion, accidents or extreme weather conditions.
5.6. Risk of loss or damage passes to you on the date the goods are delivered.
6. Substitutions
6.1. We will never substitute any products
7. Cancelling and Returns
7.1. For goods that are “made to measure” there is no right to amend or cancel your order, return the goods, or seek any refund of the price paid to us once the manufacturing process has started which includes the ordering of materials. This is simply due to the fact that the item is manufactured to your exact specification. In this case, Regulation 13(1)(c) of the Consumer Protection (Distance Selling) Regulations 2000, conditions 7.27.3 and 7.4 shall not apply
7.2. For readymade items where 7.1 does not apply you may cancel your order no later than 21 days after the date of delivery of the goods by sending a cancellation notice to us at :

7.3 If you cancel your order under 7.2, you must return the goods to us at the address in 7.2 at your own cost and expense unless they are not of satisfactory quality, fit for purpose, or as described under the interpretation of the Sale of Goods Act 1979. In this case we shall arrange for the collection of goods at our expense or re-imburse you any reasonable cost incurred by you.
7.4 You must take reasonable care of the goods whilst in your possession and re-pack them in original packaging sufficient to prevent damage in transit.
7.5 Any refunds will be processed as soon as possible but not later than 30 days after receipt by us of returned goods.
7.6 We reserve the right to cancel the contract between Window Fashion Direct Ltd and you if we have insufficient stock, or are unable to deliver to your area.
8. Guarantees
8.1. All of our goods are guaranteed against defects in manufacture and material from delivery for a period of 12 months unless otherwise stated.
9. Miscellaneous
9.1. Any contract between us will be governed in accordance with English law and resolved exclusively in the courts of England.
9.2. We will not be liable to you for any indirect or consequential loss, damage or expenses arising out of any problem you notify us of and have no liability for compensation other than to refund you the amount paid by you for the items supplied by us.
9.3. We do not accept any liability for the fitness of goods for business purposes.

11. Definitions
11.1. “we” “us” “our” means WindowFashionDirect Ltd (registered in England number 8921260)
11.2. “goods” “products” means items confirmed in our order acceptance
